Flight delay or cancellation
The EU regulations state that the passenger has the right to obtain a pecuniary refund in case of flight cancellation.
The EU Court of Justice extended this right to flight delays; therefore, even in the event of a delay, the passenger can claim a refund provided that the flight arrives with a delay of 3 hours, or more, compared to scheduled arrival time.

Also, it is to be noted that the airline can refuse to pay out any refund only if the delay is due to circumstances beyond its control.
Moreover, in the event of dispute, the burden of proof of these exceptional circumstances remains with the airline itself.
